These Terms of Use ("Terms") govern your use of the KidsPlay - YouTube for Kids application (the "App") developed and published by Kodeora ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
The App is designed for children ages 2-8 and is intended to be set up, managed, and supervised by a parent or legal guardian ("you" or "Parent").
1. Acceptance of Terms
By accessing or using KidsPlay, you confirm that:
- You are at least 18 years of age (or the age of majority in your jurisdiction)
- You are the parent or legal guardian of any child who will use the App
- You have read, understood, and agree to these Terms and our Privacy Policy
- You are responsible for supervising your child's use of the App
2. Description of the App
KidsPlay is a macOS application that provides a curated, child-safe interface for viewing YouTube Kids video content. The App includes:
- Curated YouTube Kids video categories and playlists
- Embedded YouTube video playback
- Kids stories and relaxation sound effects
- Parental controls (screen time limits, content restrictions, PIN protection)
- Multiple child profiles
- Watch history tracking for parents
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on macOS devices that you own or control, for personal, non-commercial use only.
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or disassemble the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use the App for any unlawful or unauthorized purpose
- Attempt to bypass parental controls or PIN protection
- Use the App in any manner that could damage, disable, or impair the App
4. Subscriptions and In-App Purchases
4.1 Free and Pro Tiers
KidsPlay offers a free tier with limited features and a premium tier ("KidsPlay Pro") available through in-app purchase. The free tier includes:
- 1 child profile
- 15-minute daily screen time limit
- 2 content categories
KidsPlay Pro unlocks all features, including unlimited profiles (up to 5), extended screen time options, all categories, stories, sound effects, and usage statistics.
4.2 Subscription Plans
- Pro Annual: $14.99 per year, auto-renewing
- Pro Lifetime: $24.99 one-time purchase
4.3 Billing and Renewal
All purchases are processed through the Apple App Store using your Apple ID. By subscribing to KidsPlay Pro (Annual):
- Payment is charged to your Apple ID account at confirmation of purchase
- Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
- You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase
4.4 Refunds
All purchases are made through the Apple App Store. Refund requests must be directed to Apple in accordance with Apple's refund policies. We do not process refunds directly.
4.5 Price Changes
We reserve the right to change subscription pricing. Any price changes will apply to subsequent billing cycles and will not affect the current subscription period. You will be notified of any price changes through the App Store.
5. Content Disclaimer
5.1 YouTube Content
KidsPlay displays video content sourced from YouTube. You acknowledge and agree that:
- We do not create, own, host, or control the video content displayed in the App
- Video content is provided by YouTube and its content creators and is subject to YouTube's Terms of Service
- While we curate content categories and use YouTube's safe search mode, we cannot guarantee that all video content will be appropriate for every child at all times
- Content availability may change without notice as YouTube may remove or restrict videos
- Parents are responsible for reviewing and supervising their child's viewing and using the provided parental controls to restrict content as needed
5.2 Stories and Sound Effects
Stories accessed through the App are curated YouTube playlists and are subject to the same content disclaimers above. Sound effects are original or licensed audio files bundled with the App.
5.3 No Endorsement
The inclusion of any YouTube channel, video, or content creator in our curated categories does not constitute an endorsement by Kodeora. We do not have any affiliation with the content creators whose videos appear in the App.
6. Parental Responsibility
As the parent or legal guardian:
- You are responsible for setting up and configuring parental controls appropriate for your child
- You are responsible for keeping your 4-digit PIN confidential
- You acknowledge that no content filtering system is 100% effective and you should periodically review your child's watch history
- You are responsible for determining appropriate screen time limits for your child
- You are responsible for supervising your child's use of the App, particularly for younger children
7. Intellectual Property
7.1 Our Intellectual Property
The App, including its design, interface, icons, graphics, code, and original audio content, is owned by Kodeora and is protected by copyright, trademark, and other intellectual property laws. The KidsPlay name, logo, and related branding are trademarks of Kodeora.
7.2 Third-Party Intellectual Property
YouTube, the YouTube logo, and related marks are trademarks of Google LLC. All video content displayed through the App is the intellectual property of the respective content creators and YouTube. All other trademarks referenced in the App are the property of their respective owners.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied
- We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components
- We do not warrant the accuracy, completeness, or appropriateness of any third-party content displayed in the App
- In no event shall Kodeora, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the App
- Our total liability for all claims arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim
9. Indemnification
You agree to indemnify and hold harmless Kodeora and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another party.
10. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:
- Your license to use the App will immediately cease
- You must delete all copies of the App from your devices
- Active subscriptions may be cancelled; refer to Apple's policies regarding refunds for unused subscription periods
- All locally stored data will remain on your device until you delete the App
You may terminate your use of the App at any time by uninstalling it from your Mac and cancelling any active subscriptions through the App Store.
11. App Store Terms
Your use of the App is also subject to the Apple Licensed Application End User License Agreement. In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail with respect to matters governed by Apple's terms.
You acknowledge that:
- These Terms are between you and Kodeora, not Apple
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for any product warranties, whether express or implied
- Apple is not responsible for addressing any claims related to the App
- Apple is a third-party beneficiary of these Terms and may enforce them against you
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kodeora is established, without regard to conflict of law principles. Any disputes arising from these Terms or the use of the App shall be resolved through good-faith negotiation, and if necessary, through binding arbitration in accordance with applicable law.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kodeora regarding your use of the App and supersede all prior agreements, understandings, and communications.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
For material changes, we will make reasonable efforts to provide notice through the App or via the App Store update notes.
